All seems to have gone quiet on this one , but I was very surprised today to receive a cheque from HM Paymaster General in relation to a " first and final dividend of 11p in the £ ". Pleased to see that " there is no need to forward a receipt " as the cheque is for 69p.

After the removal of all assets which are subject to retention of title arrangements, fixed security, or are otherwise subject to proprietary claims of others, the liquidator will pay the claims against the company's assets. Generally, the priority of claims on the company's assets will be determined in the following order:

Liquidators costs
Creditors with fixed charge over assets
Costs incurred by an administrator
Amounts owing to employees for wages/superannuation
Payments owing in respect of workers's injuries
Amounts owing to employees for leave
Retrenchment payments owing to employees
Creditors with floating charge over assets
Creditors without security over assets
Shareholders (Liquidating distribution)

Unclaimed assets will usually vest in the state as bona vacantia.

As I understand it, HMRC used to be a prefered creditor under British law and used to get paid before others. (The right of the Crown as a preferential creditor was removed by the Enterprise Act 2002.)

In this case HMRC put the claim in after the first dividend had been paid. The liquidator had the choice to accept the claim or not and chose to accept it. Because the claim was late there was no requirement to pay HMRC a first dividend. So they got the balance!

All claimants are equal
What appears to have happen here is the HMRC were V late in getting their claim in

Maybe that's what you would like to happen??

In fact they have no priority over any other unsecured creditors.

Got my letter of confirmation this morning - no new dividend because of HMRC.

Still, with Richards generous offer to meet our losses originally AND the initial dividend I'm not sure any of us are out of pocket.

And at least the matter is now over for all concerned. And HMRC always get priority against the small claimants

Some time ago I mailed FA Simms to see what was happening. Just got a reply today:

Dear mgf

I apologise for the delay in my response to your email below.

It was the intention of the Liquidator to declare a second distribution (the amount of which would depend on the proofs received) but unfortunately we became aware of an issue which we have been investigating and we are continuing to liaise with legal advisors in an attempt to resolve it. As this matter has not yet been resolved, the Liquidator and his team have been unable to provide a definitive response to creditors in relation to this.

I would hope that this issue will be resolved and a full response sent to creditors by the end of June.
